These Terms & Conditions provide clarity around the purchase, creation, delivery and use of personalised audio recordings from The Soul Alliance.
Each personalised recording is created with genuine care and individual attention. These Terms help ensure that you understand what to expect from the process and how your recording may be used.
Please read these Terms & Conditions before purchasing a personalised recording.
By completing the required acceptance at checkout and purchasing a personalised recording, you agree to these Terms & Conditions.
1. About These Terms
These Terms & Conditions apply to personalised audio recordings created by The Soul Alliance, operating from Queensland, Australia (“The Soul Alliance”, “we”, “us” or “our”).
They apply specifically to recordings individually created or adapted for a particular person using information, intentions, preferences, questionnaire responses or other information provided for the purpose of creating that recording.
Separate terms apply to ready-made or pre-recorded digital audios available for general purchase through The Soul Alliance website.
2. Your Personalised Recording
Your personalised recording is individually created using the information you choose to provide, including your requested focus and responses to any questionnaire provided by The Soul Alliance.
You are responsible for providing information that is accurate and relevant to the creation of your recording.
You do not need to provide information that is unrelated to the purpose of your recording.
The Soul Alliance may contact you if clarification is reasonably required before your recording can be created.
3. Requested Focus & Suitability
The Soul Alliance may reasonably adapt, refine or decline a requested focus where we consider the requested content inappropriate, outside our scope, unsuitable for this form of support or otherwise not appropriate for us to provide.
Where appropriate, we may work with the underlying intention of your request and create an alternative focus that remains aligned with the purpose of the recording you purchased.
If The Soul Alliance ultimately cannot provide the purchased recording, an appropriate remedy will be provided in accordance with applicable consumer law and our Cancellation & Refund Policy.
4. Payment
Personalised recordings require full payment at the time of purchase, unless The Soul Alliance has expressly agreed otherwise in writing.
Your order will be processed once payment has been successfully received.
5. Completing Your Questionnaire
Where a questionnaire or other information is required to create your personalised recording, it must be completed and submitted within one (1) month of purchase.
Your recording cannot be created until The Soul Alliance has received the information reasonably required to create it.
If you delay submitting your questionnaire or required information, the creation and delivery timeframe will be delayed accordingly.
If the required information is not provided within one month of purchase, The Soul Alliance is not required to keep the personalised recording order open indefinitely, subject to applicable consumer law and our Cancellation & Refund Policy.
6. Creation & Delivery Time
Once your completed questionnaire and any other reasonably required information have been received, your personalised recording will ordinarily be created and delivered within seven (7) business days.
Business days are Monday to Friday, excluding Queensland public holidays.
If unexpected circumstances mean this timeframe cannot reasonably be met, The Soul Alliance will endeavour to let you know and provide an updated timeframe.
Nothing in this section limits any rights you may have under applicable consumer law.
7. No Revisions
Personalised recordings are individually created using the information and requested focus you provide.
Once your recording has been created, revisions or changes of mind are not included.
This includes requests to change wording, affirmations, themes, preferences, intentions or the requested focus after the recording has been created.
This does not affect your rights where there is a genuine error or defect attributable to The Soul Alliance or where a remedy is otherwise required under applicable law.
8. Digital Delivery
Your completed recording will ordinarily be delivered electronically by email with a download link.
You are responsible for providing a correct and accessible email address and for checking your inbox, including spam or junk folders, for delivery communications.
If you experience a genuine technical problem accessing the recording, please contact The Soul Alliance so that we can reasonably assist.
9. Downloading & Keeping Your Recording
Your personalised recording will ordinarily remain available through the provided download link for one (1) month following delivery.
Please download your recording during this period and securely save your own copy somewhere you can continue to access it.
Once the download period has ended, The Soul Alliance does not guarantee that a copy of your personalised recording will continue to be retained or available for replacement.
You are responsible for safely storing your recording once it has been delivered and downloaded.
If you lose or delete your recording after the download period, The Soul Alliance cannot guarantee that it can be recovered or resent.
10. Personal Use Only
Your personalised recording is created specifically for you and is provided solely for your personal and private use.
Your purchase does not transfer ownership or intellectual property rights in the recording or its underlying content.
Unless you have received prior written permission from The Soul Alliance, you must not:
- share or forward the recording to another person;
- upload it to the internet, social media, cloud-sharing platforms or public or private groups;
- reproduce, sell, licence, distribute or commercially exploit it;
- publish or republish it;
- create commercial derivative material from it; or
- allow another person to use a personalised recording created specifically for you.
A personalised recording may contain material designed around your individual information and circumstances and therefore may not be appropriate for another person.
11. Intellectual Property & Reuse of Content
All personalised recordings and original material created by The Soul Alliance remain the intellectual property of The Soul Alliance or the relevant rights holder unless otherwise expressly agreed in writing.
This may include hypnotherapy language and scripts, affirmations and suggestions, exercises and techniques, concepts and frameworks, structures and themes, music and sound elements, spoken content and other original creative or professional material.
Purchasing a personalised recording gives you a personal, non-exclusive and non-transferable licence to listen to and use the recording for your own personal purposes. Purchasing the recording does not transfer copyright or ownership of the recording or its underlying material to you.
In creating personalised recordings, The Soul Alliance may reuse, adapt, develop or incorporate non-identifying elements of its work in recordings, programs, digital products or other Soul Alliance offerings.
This may include general affirmations, hypnotherapy language, suggestions, scripts, themes, exercises, techniques, concepts and structures that may be useful to people exploring similar areas.
Your name, questionnaire responses, personal story, identifying details or other information that could reasonably identify you will not be disclosed or incorporated into material provided to others without appropriate permission.
A personalised recording containing your personal or identifying information will not be provided to another person.
12. Privacy & Questionnaire Information
Creating your personalised recording may involve you voluntarily providing personal, sensitive or health-related information.
The Soul Alliance will only use information provided through your questionnaire or related communications as reasonably necessary to create and administer your recording, or for another purpose permitted by law or to which you have consented.
Your information will be handled in accordance with The Soul Alliance Privacy Policy.
You are encouraged to provide information that is relevant to the purpose of your recording without providing unnecessary personal information.
13. Wellbeing & Medical Disclaimer
The Soul Alliance provides hypnotherapy, guided audio experiences and related wellbeing and personal-development support.
These offerings are intended to support areas such as personal development, relaxation, self-awareness and wellbeing.
They are not a substitute for medical, psychological, psychiatric or other appropriately qualified healthcare assessment, diagnosis or treatment.
The Soul Alliance does not provide medical, psychiatric or psychological diagnosis or treatment.
If you have concerns about your physical or mental health, you are responsible for seeking advice from an appropriately qualified healthcare professional.
Do not discontinue or alter prescribed medication or medical treatment because of something contained in or experienced through a Soul Alliance recording without consulting an appropriately qualified healthcare professional.
A Soul Alliance recording should not be relied upon as an emergency or crisis service.
14. Using Your Recording Safely
Hypnotherapy, meditation and relaxation recordings should only be listened to when it is safe for you to relax and give the recording your attention.
Do not listen while driving, operating machinery, performing tasks requiring concentration or in any situation where reduced alertness could create a risk to you or another person.
Recordings specifically intended to support sleep should only be used when you are somewhere safe and ready to sleep.
You remain responsible for choosing an appropriate time and environment in which to use your recording.
15. Individual Experiences & Outcomes
Every person’s experience of hypnotherapy, guided audio and personal-development work is individual.
The Soul Alliance creates personalised recordings with genuine care and with the intention of providing meaningful support. However, no particular outcome or result can be guaranteed.
We do not guarantee any particular personal, emotional, therapeutic, relationship, financial, health or other result from purchasing or using a recording.
Testimonials, examples and descriptions of other people’s experiences are not promises that you will experience the same outcome.
16. Recordings for People Under 18
A person does not necessarily need to be 18 or older to use a personalised recording.
Where a personalised recording is being created for a person under 18, The Soul Alliance may require the involvement or consent of a parent or legal guardian where appropriate, having regard to the young person’s age, maturity, understanding, the nature of the recording and applicable law.
The Soul Alliance may decline or modify a requested recording where we reasonably consider it unsuitable for the intended recipient.
17. Cancellation & Refunds
Because personalised recordings involve individually commissioned work created specifically for you, cancellation and refund conditions may differ from those applying to ready-made digital products.
Your purchase is subject to The Soul Alliance Cancellation & Refund Policy, which should be read together with these Terms.
Nothing in these Terms or the Cancellation & Refund Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
18. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights, guarantees or remedies available to you under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
Where you are legally entitled to a repair, replacement, re-performance, refund, compensation or another remedy, these Terms do not remove that entitlement.
Any restrictions, time limits or other conditions contained in these Terms apply only to the extent permitted by law.
19. International Purchases
Personalised recordings may be purchased by people located in Australia and internationally.
If you purchase or use a recording outside Australia, you are responsible for considering whether any requirements or restrictions apply to your use of the recording in your location.
Nothing in these Terms is intended to remove any mandatory consumer or other legal rights that apply to you under applicable law.
20. Governing Law
These Terms & Conditions are governed by the laws applicable in Queensland, Australia.
Subject to any mandatory rights or jurisdictional requirements that cannot lawfully be excluded, the parties submit to the courts and tribunals having jurisdiction in Queensland.
21. Changes to These Terms
The Soul Alliance may update these Terms & Conditions from time to time to reflect changes to our offerings, business practices or legal requirements.
The Terms applicable to your purchase will ordinarily be those made available at the time you purchase your personalised recording, unless a later change is required by law or you expressly agree otherwise.
22. Acceptance
By completing the required acceptance at checkout and purchasing and/or using a personalised recording from The Soul Alliance, you acknowledge that you have read and agree to these Terms & Conditions.
These Terms should be read together with The Soul Alliance’s Privacy Policy, Cancellation & Refund Policy and Disclaimer, which apply to your purchase and use of the recording.
Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded.
